The Hunting Exchange provides a marketplace platform connecting landowners with hunters and lessees. The Hunting Exchange is not a party to any lease agreement between users. We do not own, manage, or control any listed property, and we make no guarantees about the accuracy of listings, the condition of properties, or the conduct of users.
You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current information during registration and to update it as needed.
Landowners who list hunting leases must hold any state-required hunting lease license, landowner permit, or registration applicable to leasing their property for hunting in the state where the property is located. For example, Texas landowners must maintain a valid Texas Parks & Wildlife Department (TPWD) Hunting Lease License per Texas Parks & Wildlife Code §43.041–43.055; other states (including Oklahoma, Arkansas, Georgia, and Alabama) have their own licensing, registration, or posted-sign requirements administered by their respective wildlife agencies. Landowners are responsible for verifying that their listings are accurate, that they have legal authority to lease the property, and that they are in compliance with all applicable federal, state, and local laws — including any state-mandated posted-sign, written-notice, or recordkeeping obligations.
Hunters must hold all hunting licenses, tags, stamps, and permits required by the state in which they intend to hunt. Hunters are responsible for conducting their own due diligence on properties, including site visits where practical. Hunters agree to comply with all federal, state, and local hunting regulations — including season dates, bag limits, weapons restrictions, transportation rules, and reporting requirements — as well as all lease terms and property rules established by the landowner.
The Hunting Exchange uses Stripe to process payments. When a hunter initiates a lease, their payment is authorized but not captured. Funds are held in escrow for up to 14 days to allow a site visit. If the hunter confirms the property, funds are captured and transferred to the landowner minus the platform fee. If the hunter requests a refund within the 14-day window, the hold is released. The Hunting Exchange charges a 5% platform fee on completed transactions, deducted from the landowner payout.
The Hunting Exchange does not draft, provide, review, or guarantee any lease agreement, liability waiver, contract, or other legal document between landowners and hunters. Producing a written lease — including any terms about scope of access, liability, insurance requirements, weapons, guests, vehicles, and rules — is solely the responsibility of the parties. We recommend both parties consult with an attorney licensed in the state where the property is located before signing any document. Landowners may optionally upload their own contract PDF to a listing, which we will attach to the welcome packet as a convenience; we do not review or modify those documents and make no representation about their legal sufficiency.
Many U.S. states provide landowner liability protections for the recreational use of private land — for example, the Texas Recreational Use Statute (Tex. Civ. Prac. & Rem. Code, Chapter 75) and the Texas Agritourism Act (Chapter 75A), and analogous statutes in Oklahoma, Arkansas, Georgia, Alabama, and most other states. None of these statutes provide blanket immunity. Each has fact-specific eligibility conditions — for example, statutes may impose caps on the amount charged for access relative to property taxes, require posted signs or written notice, or limit immunity to specific activities or visitor categories. The Hunting Exchange does not represent that any such statute applies to any particular lease or jurisdiction, and the landowner is solely responsible for confirming applicability and complying with the law of the state in which the property is located. The Hunting Exchange is not a law firm, does not provide legal advice, and is not liable for injuries, damages, or losses arising from activities on leased properties.
(a) Inherent Risks. Hunters acknowledge that hunting and related outdoor activities are inherently dangerous and involve exposure to a variety of hazards, including but not limited to firearms and ammunition, tree stands and elevated blinds, terrain, wildlife encounters, weather conditions, fellow hunters, vehicles and ATVs on uneven ground, and other foreseeable and unforeseeable risks.
(b) Assumption of Responsibility. Each hunter assumes full responsibility for any risk of bodily injury, death, or property damage arising out of or related to the hunter's presence on or use of any property booked through The Hunting Exchange, including all hunting activity and any other activity while on the property, whether caused by the landowner, the hunter, another hunter, a third party, or otherwise.
(c) Duty for Guests. Hunters are responsible for the conduct and safety of any guests, companions, or invitees they bring onto the property. Neither the landowner nor The Hunting Exchange assumes any responsibility for the safety of a hunter or a hunter's guests.
(d) Release and Waiver. Hunters voluntarily release and discharge the landowner and The Hunting Exchange from any and all liability, claims, and demands of whatever kind or nature — in law or equity — that may arise from the hunter's presence on or use of any booked property. Hunters covenant not to bring any such claim or demand against the landowner or The Hunting Exchange, except for claims arising solely from gross negligence or intentional misconduct.
(e) Survival. This waiver applies to every property booking completed through The Hunting Exchange and survives the expiration or termination of any individual booking or lease agreement.
All content, design, and code on the The Hunting Exchange platform is owned by The Hunting Exchange. Users retain ownership of content they upload (photos, descriptions) but grant The Hunting Exchange a non-exclusive license to display and distribute that content on the platform.
Your use of The Hunting Exchange is subject to our Privacy Policy, which describes how we collect, use, and protect your information.
Any disputes arising from the use of The Hunting Exchange shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Texas. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against The Hunting Exchange.
Users may not: list property they do not own or have authority to lease; create false or misleading listings; harass or threaten other users; circumvent the escrow payment system; use the platform for illegal activities; scrape or extract data from the platform; or interfere with the operation of the platform.
The Hunting Exchange may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Termination does not release you from obligations under active lease agreements.
The Hunting Exchange and all content, software, functions, materials, and information made available on or through the platform are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, either express or implied. To the fullest extent permitted by law, The Hunting Exchange expressly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, and uninterrupted or error-free operation. We do not warrant that listings are accurate, that properties are safe, that users are who they claim to be, or that any transaction will be completed.
To the maximum extent permitted by law, The Hunting Exchange shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, revenue, data, goodwill, or other intangible losses — arising from your use of the platform, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for all claims arising from or relating to the platform shall not exceed the greater of (a) the amount of fees you paid to The Hunting Exchange in the twelve (12) months preceding the event giving rise to liability, or (b) one hundred U.S. dollars ($100).
Any claim or cause of action arising out of or relating to your use of The Hunting Exchange must be filed within one (1) year after the cause of action accrues, or it is permanently barred.
Each user agrees to indemnify, defend, and hold harmless The Hunting Exchange and its officers, employees, contractors, and affiliates from and against any claims, losses, damages, judgments, awards, or expenses — including reasonable attorneys' fees and court costs — arising out of or relating to: (a) the user's use of the platform; (b) the user's breach of these Terms; (c) any content the user posts, including listings, photos, reviews, and messages; (d) the user's interactions or transactions with other users; and (e) any actual or alleged violation by the user of any law, regulation, or third-party right. The Hunting Exchange reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the user, in which case the user will fully cooperate in asserting available defenses. Users may not settle any matter that affects The Hunting Exchange without our prior written consent.
The Hunting Exchange exists to facilitate transactions between landowners and hunters in a manner that protects both parties through escrow, messaging records, and dispute support. Users introduced or connected through the platform agree not to circumvent The Hunting Exchange by negotiating, arranging, or completing lease transactions off-platform when an active listing or active inquiry exists between those parties on The Hunting Exchange. Violations may result in immediate suspension or termination of accounts, removal of listings, and forfeiture of any pending bookings. We reserve the right to investigate suspected violations and take enforcement action at our sole discretion.
(a) Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Hunting Exchange concerning your use of the platform and supersede all prior or contemporaneous agreements.
(b) Severability. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified only to the extent necessary to make it enforceable while preserving its intent.
(c) No Waiver. The failure of The Hunting Exchange to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
(d) Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
(e) Modification of Terms. We may modify these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the modified Terms.
